These Terms govern your access to and use of SafeDatum, a secure data vault service operated by SafeDatum B.V. By creating an account or otherwise using the service, you agree to be bound by these Terms. Please read them carefully.
Acceptance of Terms
By accessing or using SafeDatum (the "Service"), you confirm that you have read, understood, and agree to these Terms of Service. If you are using the Service on behalf of an organization, you represent that you are authorized to bind that organization to these Terms.
We may update these Terms from time to time. Material changes will be communicated at least thirty (30) days in advance via the registered contact email or in-app notice. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
Account Registration
To use most features, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration.
- Maintain the security of your credentials and any device-bound keys.
- Promptly notify us of any unauthorized access at security@safedatum.com.
- Accept responsibility for all activity occurring under your account.
Accounts are personal. Sharing credentials or transferring an account to another individual is prohibited and may result in suspension.
Acceptable Use
You agree not to use the Service to:
- Store, transmit, or distribute unlawful, infringing, or harmful content.
- Attempt to circumvent authentication, rate limits, or other security controls.
- Reverse-engineer, decompile, or otherwise derive source code from the Service.
- Use automated systems to access the Service in a manner that exceeds reasonable use.
- Interfere with or disrupt the integrity or performance of the Service.
We reserve the right to suspend or terminate accounts that violate these restrictions, with or without prior notice depending on severity.
Your Data
You retain all rights, title, and interest in the data you store on SafeDatum ("Customer Data"). We act as a processor with respect to Customer Data and do not claim ownership of it.
All Customer Data is encrypted at rest using AES-256-GCM and in transit
using modern TLS. Encryption keys are derived from credentials you control; we
cannot recover the contents of a vault without them. Loss of credentials may result
in permanent loss of access to your data.
Service Availability
We strive to maintain high availability but do not guarantee uninterrupted service. Scheduled maintenance windows will be announced in advance where reasonably practicable. We are not liable for any downtime caused by circumstances beyond our reasonable control, including network failures, third-party providers, or acts of nature.
Fees and Billing
Paid plans are billed in advance on a monthly or annual basis. Fees are non-refundable except where required by applicable law. We may change pricing with at least thirty (30) days' notice; price changes apply at the start of your next billing cycle.
Termination
You may terminate your account at any time from your account settings. Upon termination, vault data is retained for fourteen (14) days to allow recovery in case of accidental closure, after which it is permanently and irreversibly deleted.
We may suspend or terminate your account if you materially breach these Terms, fail to pay fees, or use the Service in a manner that exposes us or other users to liability or harm.
Disclaimer of Warranties
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be error-free or that defects will be corrected.
Limitation of Liability
To the maximum extent permitted by law, SafeDatum's aggregate liability arising out of or relating to these Terms or the Service shall not exceed the greater of (a) the fees you paid to us in the twelve (12) months preceding the event giving rise to the claim, or (b) one hundred euros (€100). In no event shall we be liable for indirect, incidental, consequential, or punitive damages.
Governing Law
These Terms are governed by the laws of the Netherlands, without regard to its conflict-of-laws principles. Any disputes shall be resolved exclusively in the competent courts of Amsterdam.
